We wish to notify all our clients and former clients in simple terms, that given the recent changes in Portuguese legislation on par with that of other European countries, anyone who is non resident in Portugal (the Client) and owns property in Portugal or has interests in Portugal must be registered with the Tax Authorities in Portugal and MUST have a Fiscal Representative who is resident in Portugal (the Fiscal Representative).
The Fiscal Representative is charged with the obligation of communicating to the Client the communications received from the Tax Authorities in Portugal and to file Tax Returns where appropriate.
It is very likely that even though we may not have been in contact for a while, our colleagues or employees in Portugal are providing you with the service of Fiscal Representation and it may also be that your address in Portugal for tax purposes is lodged at their address.
In the interests of all persons who are required to have a Fiscal Representative in Portugal, the rights, duties and charges of a Fiscal Representative must be clearly understood and agreed.
Whilst our colleagues remain on record as being your Fiscal Representatives and or receive on your behalf correspondence from the Portuguese Tax Authorities they have the obligation of forwarding on to you such correspondence. This will continue to incur you a cost.
Please contact us to regularise your status and we shall be pleased to provide you with further information and standard terms of representation of Fiscal Representatives and a Legal Check Up.
Certain services must be specifically agreed and be provided by qualified persons and it is your duty to comply with Portuguese law and to notify the Fiscal Representative any change of circumstances or address and to supply to the Fiscal Representative and Tax Authorities all relevant and required information and pay all taxes to the Government as well as fees due to the Fiscal Representative.
If you fail to comply with your obligations not only the Fiscal Representative has the right to terminate the Representation but you will continue to be liable before the Tax Authorities and subject to payment of fines and interest and this could have consequences for you.
If you are intending to sell, transfer or otherwise dispose of the whole or part of your property or there has been a bereavement you should ensure that you are fully conversant with your status in Portugal and we recommend that you take advantage of a new service being provided by this Firm jointly with our Portuguese colleagues known as the LEGAL CHECK UP.

The EU harmonising legislation goes some way to allow for the near automatic recognition of Decrees of Divorces, however there are certain difficulties and formalities that must still be observed before the divorce is formally recognised as valid in Portugal.

Even though we are all in Europe and matters are now considerably easier for EU citizens, the recognition of certain divorces and orders is not automatic.
Non-EU judgments and foreign decrees will need to be registered with the Courts before they are enforceable.
Once we have witnessed or attested the Statutory Declarations, Affidavits, Powers of Attorney or Deeds or other documents we also deal with the legalisation formalities under the Hague Convention and at Embassy and Consular level in England and Portugal to be used in those countries and anywhere else in the world.
We can translate and interpret and provide you with independent legal advice prior to you signing any kind of document which may affect your interests whether it be a Will, Statutory Declaration, Affidavit, mortgage deed, power of attorney or any other document.

English law provides for strict formalities to be observed upon the signing of deeds which in Portugal, Spain and France and other civil law countries are observed by the Notary Public before whom the deeds are being executed. We will advice you as necessary.
Under English law only Solicitors of the Supreme Court of England and Wales and other authorised legal professionals are authorised to administer oaths and witness the signing of Statutory Declarations and Affidavits. We are also known as Commissioners for Oaths.
Individuals
If you are buying a property abroad more than likely you will be asked to give a Power of Attorney to a local lawyer. We take care of all the formalities and will witness or attest the signing of the power of attorney and arrange to comply with all the formalities necessary for that Power of Attorney to be recognised and accepted in the country where you wish to buy the property.
Companies
Under English law a company who wishes to grant a power of attorney must follow certain formalities. We can advice you of the requirements so that the power may be valid in another country.
In England and Wales and generally in the USA the Notary Publics do not hold the same role as in civil law countries.
The work that is normally required by law to be undertaken by public notaries in Portugal, Spain, France and other civil law countries, is undertaken in England by Solicitors of the Supreme Court of Justice of England and Wales and other qualified professionals.
Solicitors of the Supreme Court of Justice of England and Wales who are duly registered with the Law Society are entitled to do, amongst many other important and vital tasks, Conveyancing work, Transfer of Properties, Wills, Powers of Attorney and Witnessing of documents, as well as all types of instruments which work in most Civil countries is exclusively undertaken by Notary Publics.
You do not however, need to use a Notary Public specifically in England and Wales to undertake such work. Please contact us for further information and Guidance

A living will is the common name for an Enduring Power of Attorney which since April 2007 has been replaced by the Lasting Power of Attorney. Until the early 1980s Portuguese law provided that upon marriage the wife automatically acquired the nationality of her husband. Similarly under English Law, until 1973, upon marriage a wife automatically acquired the domicle of her husband.

É importante notar que até ao princípio dos anos oitenta, ao casar a mulher automaticamente perdia a nacionalidade Portuguesa e adquiria a nacionalidade do marido.
Na Inglaterra e em semelhança até 1973 ao casar a mulher automaticamente perdia a sua Lei pessoal e adquiria a lei pessoal do marido. Na lei Inglesa ,a Lei pessoal de uma pessoa é a lei do seu”domicile” .
Também é relativamente fácil e económico fazer o que se chama um "Living Will", isto é um "Enduring Power of Attorney".
Um Living Will, é uma procuração feita em vida por uma pessoa a favor de outra, a quem confere poderes para que caso fique numa situação de incapacidade física ou mental essa pessoa pode tomar conta dos seus assuntos.
Os testamentos e Living Wills são especialmente importantes para pessoas que vivem juntas, quer do mesmo sexo ou não.

Na Inglaterra o divorcio assim como o casamento revogam automaticamente um testamento, a não ser em certas circunstâncias que tenham sido contempladas especificamente no testamento

Um Representante Fiscal é uma pessoa ou companhia necessariamente residente em Portugal.
O Cargo de Representante Fiscal é muito sério na medida que o Representante Fiscal tem a obrigação de receber e transmitir ao Cliente todas as comunicações que recebe das Finanças em nome do Cliente assim como o dever de anualmente fazer entrega das relevantes Declarações de Rendimentos às Finanças.
Contudo a necessidade de ter Representação Fiscal em Portugal não é só para estrangeiros não residentes em Portugal . Os Portugueses residentes no estrangeiro também tem a obrigação de ter Representante Fiscal em Portugal.

Em certas circunstâncias as autoridades Portuguesas e Inglesas requerem evidência que um menor está a viajar com o consentimento de ambos os pais.
Por várias razões pode acontecer que não é possível obter o consentimento de um dos pais ou ainda que já foi decretado por um Tribunal que a criança fica ao cuidado de um dos pais ou outra pessoa.
Nesses casos é necessário obter o consentimento do pai ou da mãe ou dessa outra pessoa ou comprovar quem tem juridicamente o poder paternal sobre a criança.

Embora a Lei Portuguesa imponha desde logo certas pessoas como herdeiros, através dum Testamento pode proteger os interesses das pessoas que quer beneficiar na medida permitida pela lei.
A Lei Inglesa não impõe qualquer que seja classe de beneficiários, isto é, através do testamento uma pessoa é livre de deixar, doar ou legar todos os seus bens a quem quiser, podendo assim por exemplo deserdar em todo ou em parte o seu conjugue ou os seus pais ou filhos .
